Manchester City v UEFA \u2013 Man City win after extra time and penalties\u2026<\/h1>\n

The Court of Arbitration for Sports (CAS<\/span>) has overturned\u00a0UEFA<\/span>\u2019s Club Financial Control Body\u2019s (CFCB<\/span>) sanctions against Manchester City stating that the\u00a0allegations were either unsubstantiated or \u201ctime-barred\u201d<\/a>. The\u00a0CFCB<\/span>\u00a0had imposed a two-year\u00a0UEFA<\/span>\u00a0club competitions ban and a \u00a325m fine on Man City for what it called \u201cserious breaches of the\u00a0UEFA<\/span>\u00a0Financial Fair Play (FFP<\/span>) Regulations by overstating sponsorship revenue\u201d in\u00a0information the club submitted for review<\/a>. Man City maintained that they had not breached any\u00a0FFP<\/span>\u00a0regulations and that they had \u201cirrefutable evidence\u201d\u00a0which corroborated their\u00a0innocence<\/a>.<\/p>\n

Man City\u2019s case is novel because it involves a high-profile club accused of not just breaking the\u00a0FFP<\/span>\u00a0rules but also falsification of information. As the judgement by\u00a0CAS<\/span>\u00a0concludes that there is no evidence showing concealment of information, it would be worth waiting to see if\u00a0UEFA<\/span>\u00a0based its case on the alleged emails which were leaked and then published by Der Spiegel. As is custom, full details of\u00a0UEFA<\/span>\u2019s investigation and evidence, as well the detailed findings by\u00a0CAS<\/span>, will be made public in the coming\u00a0days.<\/p>\n

Were\u00a0UEFA<\/span>\u00a0fair with Man\u00a0City?<\/h2>\n

Every football club participating in\u00a0UEFA<\/span>\u00a0club competitions must adhere to the\u00a0CFCB<\/span>\u00a0rules, including but not limited to\u00a0FFP<\/span>, which prevents clubs from spending more than what they earn.\u00a0UEFA<\/span>\u00a0through the\u00a0CFCB<\/span>\u2019s investigatory chamber monitors clubs adherence to the rules and if necessary, refer any anomaly to the adjudicatory chamber for\u00a0sanctions.<\/p>\n

In carrying out these duties, the\u00a0CFCB<\/span>\u00a0must, according to\u00a0Article 10<\/a>\u00a0of the\u00a0CFCB<\/span>\u2019s procedural rules, ensure strict confidentiality of all facts of a case until a final decision is delivered. According to Man City\u2019s statement in response to\u00a0UEFA<\/span>\u2019s original ban, the Investigatory Chamber made public in December 2018, the outcome of the case \u201cbefore any investigation had begun\u201d. Clearly, this violation of the\u00a0CFCB<\/span>\u2019s rules invoked fear of an unfair process, leading Man City to seek a neutral\u00a0arbiter.<\/p>\n

UEFA<\/span>\u2019s club competitions are prestigious and financially rewarding thus, very competitive. Assembling the best footballers does not guarantee success, but it increases a club\u2019s chances. Therefore it is no surprise that clubs have repeatedly violated the\u00a0FFP<\/span>\u00a0regulations.<\/p>\n

In most cases,\u00a0UEFA<\/span>\u00a0signs settlement agreements \u2013 an agreement which forces clubs who are in breach of\u00a0FFP<\/span>\u00a0to adhere to stipulated guidelines \u2013 however, more stringent sanctions have been issued in the past. Panathinaikos, Trabzonspor and Rubin Kazan were recently excluded from future\u00a0UEFA<\/span>\u00a0competitions for failing to comply with settlement\u00a0agreements.<\/p>\n

When Rubin Kazan, a relatively smaller club, appealed the decision,\u00a0CAS<\/span>\u00a0upheld\u00a0UEFA<\/span>\u2019s ban. Higher profile cases saw Paris Saint-Germain acquitted of wrong-doing by the Investigatory Chamber, while\u00a0AC<\/span>\u00a0Milan served a one-year suspension (reduced from a two-season ban) after\u00a0CAS<\/span>\u00a0partially upheld the Adjudicatory Chamber\u2019s\u00a0decision.<\/p>\n

Man City\u2019s\u00a0finances<\/h2>\n

The introduction of\u00a0FFP<\/span>\u00a0forced clubs to find ways of increasing their revenue from matchday and sponsorship (clubs are unable to influence broadcast revenue significantly). With the potential repercussions of ticket price increases in the mind of owners, clubs embarked on an aggressive marketing campaign to exploit their budding\u00a0brands.<\/p>\n

Puma,\u00a0SAP<\/span>, MarathonBet, Unilever, Gatorade,\u00a0PZ<\/span>\u00a0Cussons, Intel, Etihad, Etisalat, First Abu Dhabi Bank, to name a just a few, are Man City\u2019s sponsorship partners. A stone\u2019s throw away from Man City are rivals Manchester United, who even have an official mattress partner,\u00a0MLILY<\/span>; however, Man City\u2019s owner\u2019s related partners (all partners related to Abu Dhabi) are the bones of\u00a0contention.<\/p>\n

FFP<\/span>\u00a0was announced in 2009 and Man City\u2019s sponsorship revenue increased by a whopping 126% by the next year. In all fairness, Sheikh Mansour\u2019s first full year in charge of the club was also 2009. Dr Al Fahim, who was a spokesperson for the Sheikh Mansour led takeover promised that the Abu Dhabi politician would transform and make the club the biggest in England, achieving this by implementing audacious marketing plans including signing star\u00a0players.<\/p>\n

True to Dr Fahim\u2019s words, Man City have parted with \u00a31.61bn and \u00a32.2bn in transfer fees and wages to acquire some of the world\u2019s best football talents and have thirteen domestic trophies in twelve years as return on investment. The question is, did Man City achieve this within the ambit of the\u00a0law?<\/p>\n

FFP<\/span>\u00a0intends to help clubs become profitable, or at least, less loss-making. Man City\u2019s break-even-result shows an immediate upturn post-introduction of\u00a0FFP<\/span>, which on the surface level, should be welcomed by\u00a0UEFA<\/span>. However, as the name implies, financial fair play is hinged on all clubs having a level-playing\u00a0field.<\/p>\n

The\u00a0CAS<\/span>\u00a0decision has received mixed reactions from the football world and has implications for the future of the regulation.\u00a0CAS<\/span>, in its decision, observed that\u00a0UEFA<\/span>\u2019s internal investigative powers are inadequate, a damning assessment which requires immediate attention. Also, the thin-line between injection of funds by owners (limited by\u00a0FFP<\/span>) and owner-related sponsorship agreements need clarification by\u00a0UEFA<\/span>.<\/p>\n

The full implication of this landmark decision will only become apparent in the coming years as other football clubs react to this successful appeal overturning\u00a0UEFA<\/span>\u2019s original\u00a0FFP<\/span>\u00a0judgement.<\/p>\n
