This means that the healthcare professionals and family members may disagree about what healthcare treatment the patient should have.<\/p>\n<p>By way of background, the MCA is a statutory framework which sets out the relevant legal criteria for assessing whether or not a person lacks the mental capacity to make particular decisions and, if so, when, by whom, and what decisions can be made in their best interests. Under section 1 MCA, a person must be assumed to have mental capacity and a decision can only be made on that person\u2019s behalf in their best interests once they have been found to lack capacity. Capacity is assessed through a two stage test under sections 2-3 MCA, which considers whether\u00a0 the person has a disturbance or impairment in the functioning of their mind or brain and whether or not they can understand, use or weigh, and retain information relevant to the decision.<\/p>\n<div><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"container page-margin-md margin-lg\">\n<div class=\"grid grid--12\">\n<div class=\"grid__item grid__item--span-12 grid__item--span-tablet-10 grid__item--col-tablet-2 grid__item--span-desktop-6 grid__item--col-desktop-4\">\n<div class=\"richtext\">\n<h3>What\u2019s the Evidence So Far?<\/h3>\n<p>There is currently only limited evidence about the use of mediation to resolve medical treatment disputes. Dr Lindsey has written about mediation generally in <a href=\"https:\/\/www.cambridge.org\/core\/books\/reimagining-the-court-of-protection\/7216E3C6FF5B94105A8971BC72E9345C\" target=\"_blank\" rel=\"noopener\">mental capacity law<\/a> and the <a href=\"http:\/\/repository.essex.ac.uk\/28658\/\" target=\"_blank\" rel=\"noopener\">Court of Protection<\/a>, the court that deals with disputes in this area, but otherwise the data on mediation\u2019s use is <a href=\"http:\/\/www.adultcaremediation.co.uk\/Court_of_Protection_Mediation_Research_190531.pdf\" target=\"_blank\" rel=\"noopener\">incomplete<\/a>.<\/p>\n<p>While the evidence is limited, there is some reference to the use of mediation in CoP case law. For example, in <a href=\"https:\/\/www.cambridge.org\/core\/books\/reimagining-the-court-of-protection\/7216E3C6FF5B94105A8971BC72E9345C\" target=\"_blank\" rel=\"noopener\">Reimagining the Court of Protection: Access to Justice in Mental Capacity Law<\/a>, Dr Lindsey explains:<\/p>\n<p>\u2018a review of all reported CoP cases on BAILII over a ten year time period shows that 21 out of 472 (4.45%) reported cases refer to the concept of mediation\u2019<\/p>\n<p>This includes two cases that cover health and care issues, <a href=\"https:\/\/www.bailii.org\/ew\/cases\/EWCOP\/2017\/34.html\" target=\"_blank\" rel=\"noopener\">London Borough of Brent v. NB [2017] EWCOP 34<\/a> and <a href=\"https:\/\/www.bailii.org\/ew\/cases\/EWCOP\/2019\/29.html\" target=\"_blank\" rel=\"noopener\">Imperial College Healthcare An NHS Trust v. MB &amp; Ors [2019] EWCOP 29<\/a>.
