This is known as a strategic lawsuit against public participation, or Slapp.<\/p>\n<p>At the time of her assassination in 2017, Maltese investigative journalist <a href=\"https:\/\/mappingmediafreedom.ushahidi.io\/posts\/23543\">Daphne Caruana Galizia<\/a> was facing 47 civil and criminal libel suits, filed in various jurisdictions from Malta to the UK and the US.\u00a0And in Poland, the country\u2019s second largest daily newspaper, Gazeta Wyborcza, has received over <a href=\"https:\/\/fpc.org.uk\/the-increasing-rise-and-impact-of-slapps-strategic-lawsuits-against-public-participation\/\">55 legal threats<\/a>\u00a0since the Law and Justice party (PiS) came to power in 2015. The Polish cases are brought by the deputy prime minister and PiS chairman Jaros\u0142aw Kaczy\u0144ski and other powerful people with ties to the governing party.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-22544 size-full\" src=\"https:\/\/research.reading.ac.uk\/research-blog\/wp-content\/uploads\/sites\/72\/2021\/10\/newspapers-g0c7bbc3bd_640.jpg\" alt=\"colour photograph of folded newspaper, in focus to foreground blurred to background\" width=\"640\" height=\"423\" srcset=\"https:\/\/research.reading.ac.uk\/research-blog\/wp-content\/uploads\/sites\/72\/2021\/10\/newspapers-g0c7bbc3bd_640.jpg 640w, https:\/\/research.reading.ac.uk\/research-blog\/wp-content\/uploads\/sites\/72\/2021\/10\/newspapers-g0c7bbc3bd_640-300x198.jpg 300w\" sizes=\"auto, (max-width: 640px) 100vw, 640px\" \/><!--more--><\/p>\n<p>Slapps are used to try to prevent the public from learning about matters of <a href=\"https:\/\/digitalcommons.wcl.american.edu\/cgi\/viewcontent.cgi?article=2166&amp;context=aulr\">public interest<\/a> that could harm the reputation of a company or government. They typically take the form of defamation lawsuits but, very often, the companies or individuals who start these claims know they will never win. Rather, the aim of the claim (and this is what makes it a Slapp) is to dissuade journalists from reporting on a controversial story by making it as costly and time-consuming as possible.<\/p>\n<p>People or organisations who instigate Slapps are often powerful and well funded, while defendants tend to be people and organisations with significantly <a href=\"https:\/\/digitalcommons.lmu.edu\/cgi\/viewcontent.cgi?article=3105&amp;context=llr\">less resources and influence<\/a>. This is especially concerning when you consider that many independent journalists who bring attention to complex issues or scandals do not have the financial and legal support of a major media company behind them.<\/p>\n<p>The effect of defamation complaints on freedom of speech is illustrated by recent comments by the website <a href=\"https:\/\/www.opendemocracy.net\/en\/opendemocracyuk\/jeffrey-donaldson-sued-us-heres-why-were-going-public\/\">openDemocracy<\/a> about a legal action pursued against them by Jeffery Donaldson, the now Democratic Unionist Party leader over a story they published.<\/p>\n<p>openDemocracy said: \u201cThose two years cost us a lot. We spent months dealing with legal letters, burning through thousands of pounds and precious time that would otherwise have been spent on our journalism. The psychological toll was even higher.\u201d The case never went to court.<\/p>\n<p>If this is not concerning enough, what is even more worrying for the public is what we do not get to read about as a result of <a href=\"https:\/\/www.ecpmf.eu\/wp-content\/uploads\/2021\/07\/Policy-Paper-Countering-legal-intimidation-and-SLAPPs-in-the-UK.pdf\">Slapps<\/a>, such as the <a href=\"https:\/\/www.ft.com\/content\/48b6a350-ad29-11e4-bfcf-00144feab7de\">blocked UK publication<\/a> of Karen Dawisha\u2019s book <a href=\"https:\/\/www.forbes.com\/sites\/paulroderickgregory\/2014\/10\/14\/putins-reaction-to-sanctions-is-destroying-the-economy-and-china-wont-help\/?sh=f670f6f26a9d\">Putin\u2019s Kleptocracy<\/a>.<\/p>\n<p><strong>Growing use<\/strong><span style=\"letter-spacing: 0.08px\">\u00a0some US states, such as <\/span><a style=\"letter-spacing: 0.08px\" href=\"https:\/\/escholarship.org\/uc\/item\/92n3k361\">California<\/a><span style=\"letter-spacing: 0.08px\">, anti-Slapp legislation and <\/span><a style=\"letter-spacing: 0.08px\" href=\"https:\/\/www.cambridge.org\/core\/journals\/legal-studies\/article\/abs\/an-analysis-of-three-distinct-approaches-to-using-defamation-to-protect-corporate-reputation-from-australia-england-and-wales-and-canada\/F7B6A48FCA80708CAE1DFB551A992B6C\">well-developed case law<\/a><span style=\"letter-spacing: 0.08px\"> have existed for a number of years to restrict their deployment and protect free speech. In the European Union, and the UK, where no such laws exist, the increasing use of Slapps has worried civil rights activists and journalists, and there are now attempts to introduce in similar legislation in both places.<\/span><\/p>\n<p><span style=\"letter-spacing: 0.08px\">In\u00a0<\/span><a style=\"letter-spacing: 0.08px\" href=\"https:\/\/theconversation.com\/anti-slapp-laws-help-keep-frivolous-lawsuits-out-of-the-courts-but-not-every-province-has-them-162579\">Canada<\/a><span style=\"letter-spacing: 0.08px\">\u00a0and in<\/span>Initiatives to monitor and combat Slapps are now being launched across Europe. For example, the <a href=\"http:\/\/www.the-case.eu\/\">Coalition Against Slapps in Europe<\/a>, launched in March 2021, and saw 106 civil society organisations sign a public call for the Council of Europe to take steps to combat Slapps.<\/p>\n<p>Another initiative launched in December 2020 is pushing for the adoption of a <a href=\"https:\/\/dq4n3btxmr8c9.cloudfront.net\/files\/zkecf9\/StopSLAPPs_04Dec.pdf\">European Union directive<\/a> to combat Slapps. And in June 2021, a study commissioned by the European Parliament\u2019s Policy Department for Citizens\u2019 Rights and Constitutional Affairs recommended the adoption of an anti-Slapp directive, and changes to EU law to limit the damage being <a href=\"https:\/\/www.europarl.europa.eu\/RegData\/etudes\/STUD\/2021\/694782\/IPOL_STU(2021)694782_EN.pdf\">done by Slapps<\/a>.<\/p>\n<p>Slapps have also reached UK shores. A <a href=\"https:\/\/fpc.org.uk\/publications\/unsafe-for-scrutiny\/\">November 2020 report<\/a> from the <a href=\"https:\/\/fpc.org.uk\/\">Foreign Policy Centre<\/a>, which surveyed European investigative journalists covering crime and corruption, found that the UK was by far the most frequent international country of origin for legal threats after the journalists\u2019 home countries. The report also found that legal threats were more likely to effect the journalists\u2019 ability to continue working than psychosocial, physical or digital threats.<\/p>\n<p>In January 2021, the <a href=\"https:\/\/www.ecpmf.eu\/wp-content\/uploads\/2021\/07\/Policy-Paper-Countering-legal-intimidation-and-SLAPPs-in-the-UK.pdf\">UK Anti-Slapp Coalition<\/a> was formed by 22 organisations. They recently published a joint <a href=\"https:\/\/www.ecpmf.eu\/wp-content\/uploads\/2021\/07\/Policy-Paper-Countering-legal-intimidation-and-SLAPPs-in-the-UK.pdf\">policy paper<\/a> countering legal intimidation and Slapps in the UK. It calls for a formal UK parliamentary inquiry to examine this issue, including its effect on public debate and discussion, and to consider a UK anti-Slapp law.
